The German version of this document is the legally binding one.

These Terms of Use apply to the use of the CobleCook app and the related services.

By registering for and using CobleCook, you accept these Terms of Use.

1. Our Service

1.1. CobleCook is an app for privately organizing cooking together. With CobleCook, you can in particular collect recipes, create cookbooks, plan meals, create weekly meal plans and manage shopping lists.

1.2. Certain features can be used together with other CobleCook users. These include, in particular, shared households and events.

1.3. Registration and certain basic CobleCook features are free of charge.

1.4. Additional features may be subject to a fee. These include, in particular:

• shared use of a household as part of a CobleCook subscription; and
• enabling an event for other people by creating an invite code as a one-time in-app purchase.

1.5. CobleCook is intended exclusively for private use. Commercial use, in particular by restaurants, catering companies, food retailers or other businesses, is not permitted without our prior consent.

2. Registration and User Account

2.1. A personal user account is generally required to use CobleCook.

2.2. Registration is only permitted for natural persons who are at least 18 years old and have full legal capacity.

2.3. Registration takes place using an email address and password. You are required to provide correct information and keep the email address stored in your account up to date.

2.4. Your login credentials are personal and may not be shared with other persons. You are required to take appropriate measures to protect your password against access by third parties.

2.5. If you suspect that another person has gained access to your user account without your consent, please notify us immediately at support@coblecook.de.

2.6. As a general rule, only one user account may be created per person. There is no entitlement to registration or to the permanent provision of a user account.

3. Free User Account and Deletion

3.1. You may delete your free user account at any time without stating a reason. To do so, go to “Settings” within the app.

3.2. Deleting your CobleCook account does not automatically terminate a subscription concluded via the Apple App Store. Such a subscription must additionally be managed or cancelled using the features provided by Apple. To do so, go to “Settings” -> “iCloud” -> “Subscriptions” on your iPhone.

3.3. We may generally terminate a free user account by providing 14 days' notice. Our right to suspend an account or terminate it for cause remains unaffected.

3.4. After deletion of a user account, personal content and data may be deleted or anonymized unless statutory retention obligations or other legitimate reasons require continued storage.

3.5. Recipes that have been added to the general CobleCook recipe catalogue in accordance with Section 8 of these Terms of Use will remain part of the CobleCook service even after the user account has been deleted.

3.6. For such recipes, the public catalogue will not indicate which user originally submitted the recipe. Personal notes and personal recipe images will not become part of the public catalogue and will not be published in connection with a recipe that remains in the catalogue.

4. CobleCook Subscription and Shared Household

4.1. Personal use of CobleCook's basic features is free of charge.

4.2. A paid CobleCook subscription is required to use a household together with other persons.

Participants in a household must be approved by the person who created the household.

4.3. Within a shared household, participating persons can in particular view and edit the following content together:

• weekly meal plans,
• shopping lists, and
• the shared cookbook and the recipes saved within it.

Changes made by one participant may therefore immediately affect content visible to other participants.

4.4. The CobleCook subscription is offered through the Apple App Store as a subscription with an initial term or billing period of six months.

Where offered, and provided that the user is eligible under Apple's terms, the paid subscription may be preceded by a seven-day free trial period.

After the free trial period ends, the subscription becomes chargeable unless it has been cancelled within the period specified by Apple.

4.5. The subscription renews automatically in accordance with the terms displayed in the Apple App Store when the subscription is purchased, unless it is cancelled in due time.

For consumers whose habitual residence is in Germany, automatic renewal applies only to the extent permitted by mandatory German consumer law. Where renewal for another fixed term is not legally permitted, the legally permissible renewal and cancellation provisions shall apply instead.

4.6. The purchase, payment processing, management and cancellation of the subscription are handled via the Apple App Store. The terms and conditions displayed there at the time of purchase additionally apply.

4.7. If you cancel your subscription, you may generally continue to use the paid features until the end of the period already paid for or otherwise indicated by Apple. Afterwards, the free version of CobleCook available at that time will remain accessible to you.

4.8. Subject to mandatory statutory provisions, there is no entitlement to any particular paid or free feature being offered permanently in an unchanged form.

5. Events and Invite Codes

5.1. CobleCook allows you to create events free of charge, for example to plan meals, recipes, shopping or drinks together with friends.

5.2. An event initially created only for yourself can be created and managed without any paid activation.

5.3. If you would like to invite other people to an event, you can activate an invite code for that event.

5.4. Activating the invite code is a one-time in-app purchase. The current price is EUR 2.99 including any applicable VAT. The price displayed in the Apple App Store immediately before completing the purchase is decisive.

5.5. Once activated, a generally unlimited number of CobleCook users can be invited to that event. A separate activation is required for each additional event.

5.6. You may create multiple events free of charge. Costs are only incurred when an invite code is activated for a specific event.

5.7. An activated event generally remains available until the creator deletes it or until the event must be removed for another legitimate reason.

5.8. All participants in an event require their own CobleCook user account and must be at least 18 years old.

5.9. Alcoholic beverages may also be selected or included in the planning within events. CobleCook does not sell or broker alcoholic beverages as a result. Users are responsible for complying with applicable legal requirements relating to the actual purchase, provision and consumption of alcoholic beverages.

5.10. The purchase and payment processing of invite codes are handled via the Apple App Store.

5.11. By purchasing an invite code, you request that activation be provided immediately after successful payment processing.

6. Payments, Cancellation, Withdrawal and Refunds

6.1. Paid CobleCook services are currently offered via the Apple App Store.

6.2. Payment processing, payment methods, subscription management, cancellation, withdrawal and refunds are additionally subject to the applicable terms and processes of Apple.

6.3. Statutory consumer rights remain unaffected.

6.4. Where, at your express request, the performance of a digital service or provision of digital content begins during a statutory withdrawal period, the statutory provisions and the declarations made as part of the respective purchase apply with regard to any right of withdrawal.

7. User Obligations and Prohibited Use

7.1. You may use CobleCook only in accordance with applicable law and these Terms of Use.

7.2. In particular, you may not:

• upload or distribute unlawful content,
• infringe copyrights, trademark rights, personality rights or other rights of third parties,
• upload or import content that you are not authorized to use,
• use malware, scripts or other technical mechanisms capable of impairing CobleCook, our systems or other users,
• circumvent technical protection measures,
• automatically or systematically extract, scrape, copy or reproduce data from CobleCook,
• use the CobleCook recipe catalogue to create a competing service, your own recipe database or another commercial service,
• use another person's user account without their consent, or
• otherwise misuse CobleCook.

7.3. If these Terms of Use are violated, we may remove content and temporarily suspend user accounts or individual features.

7.4. In the event of serious or repeated violations, we may terminate the contractual relationship for cause and permanently suspend or delete the user account where this is appropriate in consideration of the circumstances of the individual case.

8. Recipes and the CobleCook Recipe Catalogue

8.1. CobleCook distinguishes between recipes intended for the general CobleCook recipe catalogue and content stored exclusively in your personal area.

8.2. Manually Created Recipes

If you manually create or upload your own recipe in CobleCook, this recipe may automatically be added to the general CobleCook recipe catalogue.

By submitting such a recipe, you expressly agree that the recipe may also be displayed to other CobleCook users and used permanently within CobleCook.

The general recipe catalogue will not indicate which user originally submitted the recipe.

8.3. Imported Recipes

Recipes imported from external sources, in particular

• via Instagram or comparable services, or
• by photographing, scanning or uploading an existing recipe,

will be stored exclusively in your personal area and will not automatically be added to the general CobleCook recipe catalogue.

For such content, you grant us only those rights that are technically necessary to enable storage, processing and use of the content within CobleCook for you.

8.4. Third-Party Rights

You are responsible for ensuring that you are authorized to submit or import a recipe.

In particular, you may not publicly provide third-party texts, images or other copyright-protected content as your own content unless you are authorized to do so.

9. Rights of Use for Recipes in the CobleCook Catalogue

9.1. Content created by you generally remains available for your own use.

9.2. In order for CobleCook to permanently use a recipe manually created by you and added to the recipe catalogue, you grant testr Research GmbH, upon submission, a royalty-free, worldwide, perpetual, unrestricted as to content, transferable, sublicensable and non-exclusive right to use the respective recipe.

9.3. This right of use includes, in particular, the right to:

• store and reproduce the recipe,
• make it publicly accessible within CobleCook and other CobleCook services,
• display and recommend it to other users,
• edit it editorially and technically,
• correct spelling and grammatical errors,
• technically process quantities, units and formats,
• structure the recipe,
• translate it,
• process it using automated systems or artificial intelligence,
• use individual components or excerpts,
• combine it with other content or data,
• make it available in other forms of presentation,
• use it for marketing and advertising purposes for CobleCook, and
• commercially exploit it in connection with CobleCook and other services offered by testr Research GmbH.

9.4. The rights granted remain in effect even after deletion of your user account.

9.5. After deletion of the user account, CobleCook may continue to use such a recipe anonymously within the recipe catalogue and for the purposes described in this Section.

9.6. You warrant that you have the necessary rights and that the contractual use of the recipe does not infringe any third-party rights.

9.7. Personal notes relating to a recipe are not part of the public recipe and are covered by the rights described above only to the extent technically necessary to provide your personal features.

10. Your Own Images

10.1. Images personally uploaded by you in connection with a recipe will not automatically become part of the general CobleCook recipe catalogue and will not be published as public recipe images.

10.2. You grant us the rights to use these images that are technically necessary to provide the CobleCook features.

10.3. This includes, in particular, the right to:

• store images,
• compress images,
• adjust their size and resolution,
• create previews or thumbnails, and
• analyze images automatically or using artificial intelligence to the extent this serves the provision of CobleCook features.

10.4. This does not give CobleCook the right to publish your personal recipe image in the general recipe catalogue or use it for advertising without a separate legal basis or authorization.

11. AI-Generated Content and Recipes

11.1. CobleCook may offer features in which recipes or parts of recipes are generated, supplemented, structured, translated or edited using artificial intelligence.

11.2. Where a recipe has been substantially generated using artificial intelligence, this will be indicated accordingly within CobleCook.

11.3. AI-generated content may contain errors despite technical and editorial measures. It should therefore not be relied upon without verification.

11.4. Before preparing an AI-generated recipe, you are in particular required to independently verify whether:

• the ingredients and quantities are plausible,
• the preparation steps appear correct and complete,
• temperatures and cooking times are safe and appropriate,
• the foods used are suitable for the intended consumption, and
• potential allergens, intolerances or other health-relevant factors have been taken into account.

11.5. Information provided within CobleCook does not constitute medical, nutritional-medical or other professional health advice.

11.6. In particular, in the case of allergies, intolerances, medical conditions, pregnancy or other health-relevant circumstances, you must not rely exclusively on information generated automatically by CobleCook.

12. Shared Content

12.1. If you join a shared household or event, certain content may be visible to all participants in that household or event.

12.2. Where a feature enables collaborative editing, other participants may add to, modify or delete this content.

12.3. You should therefore only enter information in shared areas that is intended for the other participants.

12.4. CobleCook accepts no responsibility for changes made to shared content within a household or event by other participants authorized by you.

13. Availability, Data Backup and Changes to the Service

13.1. We endeavour to provide CobleCook as reliably and continuously as possible.

13.2. However, we cannot guarantee that CobleCook will be available at all times without interruption, errors or restrictions.

13.3. In particular, maintenance work, updates, technical disruptions, disruptions affecting third-party providers or necessary security measures may result in temporary restrictions.

13.4. We are entitled to modify, further develop, replace or discontinue individual features provided that this does not violate mandatory statutory or contractual rights.

13.5. We will generally notify you at least two weeks in advance of material changes to a paid subscription that significantly affect its use or scope of services, unless a shorter period is required for legal, security-related or mandatory technical reasons.

13.6. Statutory rights relating to changes to digital products remain unaffected.

14. Warranty and Liability

14.1. Statutory warranty rights apply.

14.2. We are liable without limitation for damage caused intentionally or through gross negligence by us, our legal representatives or agents.

14.3. In the event of ordinary negligence, we are liable only for the breach of an essential contractual obligation. In such cases, liability is limited to the damage typically foreseeable at the time the contract was concluded.

14.4. The above limitations of liability do not apply:

• to damage resulting from injury to life, body or health,
• in cases of fraudulent concealment,
• where an express guarantee has been assumed, or
• where liability exists under the German Product Liability Act or other mandatory statutory provisions.

14.5. Recipes and cooking information may contain errors, particularly in the case of user-generated or AI-generated content. The information and warnings in Section 11 should therefore be observed with particular care.

15. Data Protection

15.1. Information about which personal data we process, the purposes for which such processing takes place and the rights available to you can be found in our separate CobleCook Privacy Policy.

15.2. The Privacy Policy does not form part of these Terms of Use and is made available separately within the app or via our website.

16. Changes to these Terms of Use

16.1. We may amend these Terms of Use where there is an objective reason for doing so, in particular due to:

• changes in statutory requirements,
• new or amended case law,
• technical developments,
• security requirements, or
• changes or extensions to the CobleCook service.

16.2. We will inform you of material changes in due time before they take effect via CobleCook or via the email address stored in your user account.

16.3. We will generally notify you at least two weeks before material changes affecting an existing paid subscription take effect.

16.4. Where your express consent to an amendment is required by mandatory statutory provisions, we will obtain such consent.

16.5. Statutory rights of cancellation, objection and other consumer rights remain unaffected.

17. Final Provisions

17.1. The contractual language is German.

17.2. The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer and have your habitual residence in another country, mandatory consumer protection provisions of that country remain unaffected.

17.3. You may offset claims against us only against counterclaims that are undisputed or have been finally adjudicated. Your statutory rights, in particular regarding claims arising from the same contractual relationship, remain unaffected.

17.4. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

17.5. If individual provisions of these Terms of Use are or become wholly or partially invalid, the remaining provisions shall remain unaffected.
